General terms and conditions of website use

 

1. SCOPE OF GTU

The Centre Technique Interprofessionnel des Fruits et Légumes (hereinafter ‘CTIFL’) as defined in articles L.521-1 et seq. of the French Research Code, is the research and development organisation at the service of the fruit and vegetable sector, from production to distribution.

The present General Terms and Conditions of Website Use (hereinafter ‘GTU’) govern the use of the website operated by the CTIFL located at www.ctifl.fr ("the Website") by any user accessing the Website ("the User" or "you").

By accessing or using the Website, you acknowledge that you have read and agree to these GTU.

The CTIFL reserves the right to modify at any time the present GTU and advises you to check them regularly. The applicable GTU are the ones in effect at the time of each use of the Website.

The present GTU remain applicable to you as long as you are a User of the Website.

 

2. PRESENTATION OF THE WEBSITE

2.1. Purpose of the Website

The site provides detailed information on the CTIFL's missions, activities, research projects, services, events and publications for professionals in the sector, scientific partner organisations and the press.

It includes a personal space to which access is reserved for anyone who wishes to do so. This space allows you to:

  • Modify your profile
  • Make online purchases
  • Have a history of your purchases, subscriptions and invoices in one place
  • Browse your wish list of purchases
  • Subscribe or unsubscribe to the CTIFL newsletters
  • Access the Question & Answer Service

Your personal space is governed by the present GTU.

Any use of this information and data shall be at your own risk.

2.2. Access to the Website

You shall be personally responsible for the implementation of IT and telecommunication resources allowing access to the website and for the knowledge required to use the Internet and to access the website.

You shall bear the connection and equipment costs associated with accessing the Internet and using the Site.

You use the Website at your own risk. You undertake to use the Website in a responsible and lawful manner, in particular by:

  • not accessing data that is not intended for you.
  • communicating, where appropriate, lawful, sincere and accurate information through the website.

It is forbidden to attempt to obtain unauthorised access to the service, to access the website or to remain on it by any means other than the interface that is provided to you by the CTIFL for this purpose.

 

3. PERSONAL SPACE

3.1 Creation of your personal account

In order to benefit from the functionalities offered in the Personal Space, you must create an account.

This procedure to create an account includes the following steps:

  • The online registration form shall be filled in, the mandatory fields being marked with an asterisk. The chosen password must comply with the security criteria recommended by the Commission Nationale Informatique et Libertés (CNIL), i.e., a password containing 8 characters, with at least 3 of the 4 following types of characters: upper case, lower case, numbers, special characters. A bar visually identifies the security level of the password.
  • The GTU shall be read and accepted by ticking the box provided for this purpose. Without acceptance, creation of the Personal Space cannot be completed.
  • After validation of the form, a confirmation e-mail is sent to the person wishing to create his/her Personal Space at the e-mail address provided. He/she is asked to click on the activation link included in this email to activate the account.
  • The Holder of the Personal Space undertakes to provide accurate and complete information and to update this information regularly. It is possible to request their modification online by logging into their Personal Space.

3.2 Confidentiality of identifiers

The Account Holder is solely responsible for the preservation, conservation and confidentiality of his/her password and other confidential data that may be transmitted to him/her via their Personal Space.

The Account Holder shall take all actions reasonably necessary to ensure complete confidentiality.

Any use of a password implies the use of the services offered on the Website by the Account Holder to whom the password belongs.

The Account Holder undertakes to notify the CTIFL without delay of any communication to third parties or theft of his/her password. A link will be sent to him/her to change his/her password.

The CTIFL cannot be held responsible in case of fraudulent or improper use, or voluntary or involuntary disclosure of his/her login and/or password to anyone.

3.3. Closure or suspension of the Personal Space

The Account Holder may at any time request the closure of his/her Personal Space, without prior notice, free of charge, by logging into his/her Personal Space. The account will be closed as soon as possible.

 In case of suspected fraudulent use of the Personal Space, the CTIFL reserves the right to suspend or close the Personal Space without any compensation or notice.

The Account Holder remains responsible for any use of his/her Personal Space prior to the closure or suspension of his/her account.

In the event of the death of the account holder, the CTIFL will delete his/her Personal Space as soon as possible after being notified of the death.

 

4. LIMITATION OF LIABILITY

The information on this site is as accurate as possible and the site is periodically updated but may contain inaccuracies or omissions. If you notice an omission, error or what appears to be a malfunction, please report it via the contact form, describing the problem as precisely as possible (page causing the problem, triggering action, type of computer and browser used, etc.).

The User is responsible for ensuring the accuracy of the information provided on the Website. The CTIFL is in no way responsible for the use made of this information and for any direct or indirect prejudice that may result from it.

Any download of content is done at the user's own risk and under his/her sole responsibility. Consequently, the CTIFL cannot be held responsible for any damage to the user's terminal (e.g., computer or smartphone) or for any loss of data resulting from the download.

The photos are not contractual.

In accordance with article 7 of these GTU, the CTIFL disclaims all liability for the content or the risks of use of other websites published by third parties to which the links lead outside the ctifl.fr domain.

 

5. INTELLECTUAL PROPERTY RIGHTS

All the content of this website, including -but not limited to- graphics, pictures, texts, videos, animations, sounds, logos, GIFs and icons, as well as their layout, is the exclusive property of the CTIFL and/or its partners.

Any reproduction, distribution, modification, adaptation, retransmission or publication, even partial, of these different elements is strictly forbidden without the express written consent of the CTIFL. This representation or reproduction, by any means whatsoever, may constitute an infringement that may incur the civil and criminal liability of the infringer. The CTIFL reserves the right to take legal action against the counterfeiter.

The website users and visitors may set up a hyperlink leading to this site, but only to the home page, accessible at the following URL www.ctifl.fr, provided that this link opens in a new window.  Unless expressly authorised by the CTIFL, any deep link (leading to a sub-page) is prohibited, as well as the opening of this site within a frame ("framing"). The CTIFL reserves the right to ask for the removal of a link that is not considered to be in accordance with the purpose of the Website (in particular with the present GTU), that is defamatory, or that infringes, parasiting or violates its rights or those of third parties.

The present conditions shall be governed by French law and any dispute or litigation that may arise from the interpretation or execution of these conditions will come within the exclusive jurisdiction of the courts on which the CTIFL headquarters depends. The reference language for the settlement of any dispute is French.
